DHCR Requirement for Site Specific Survey and Check List
New HUD Standards that will be retroactive on any project that has a set up after June 1st 2009.
HUD Environmental Standards
1. For five or more units:
a. When a building is to be acquired by the LPA, submit the “executive summary” or “Conclusions and Recommendations” of a Phase 1 Environmental Site Assessment (ASTM Standard E1527).
b. For all other buildings receiving HOME funding assistance, submit a letter from a qualified environmental professional that states that a site visit was conducted and the site is not located on or near any hazardous materials or contamination.
2. For four or fewer units, submit a letter from a qualified environmental professional that states that a site visit was conducted and the site is not located on or near any hazardous materials or contamination.
New HUD Asbestos Standards Air Quality (Asbestos) Documentation for the Air Quality (Asbestos) section of the checklist:
1. For a 3 or more unit building an asbestos survey by a licensed asbestos contractor is required. This person can be in-house or an outside contractor, so long as he or she is certified in compliance with NYSDOL Section 56-3.2(d) to conduct asbestos surveys.
2. For a 1 or 2 unit building: a. If the work is contracted for and the owner does not direct or control the work, a survey is not required. b. If the work is done in-house, an asbestos survey by a licensed asbestos contractor is required. This person can be in-house or an outside contractor, so long as he or she is certified in compliance with NYSDOL Section 56-3.2(d) to conduct asbestos surveys.
3. If no rehabilitation or demolition will occur, no further action is required.
4. If an in-house employee conducts the survey, that same person cannot be responsible for asbestos clearance of the project. The same in-house employee who conducts the survey may also conduct the project work. All in-house employees who conduct any asbestos handling, sampling or work must be properly certified pursuant to NYSDOL Section 56-3.2(d). There are nine types of Certificates available. All in-house employees who conduct asbestos handling must have the appropriate Certificate for their activity type.
